Temporary Letters of Administration of Butler L. Davis

Georgia, Haralson County} To the Ordinary of said County: The petition of B. L. Davis respectfully showeth that B. Davis, resident of said county, departed this life on the 21st day of Jany 1921, leaving your petitioner as his next of kin, and also leaving an estate of real and personal property, worth the sum of about Five Thousand Dollars; and at the time of his death the said B. Davis was entirely intestate, as your petitioner believes, and herein alleges. Wherefore, he prays the usual citation in such cases to issue, in order that he may obtain Permanent Letters of Administration on said estate, and your petitioner will ever pray. Signed: B. L. Georgia, Haralson County, To all Whom it May Concern} B. L. Davis has applied to me for Permanent Letters of Administratin on the estate of B. Davis, late of said County, this is to cite all and singular the creditors and next of kin of B. Davis to be and appear at my office within the time allowed by law, and show cause, if any they can, why permanent administration should not be granted to B. L. Haralson Court of Ordinary, Haralson Term, March 7th, 1921. Citation having been duly issued and published, requiring all and singular next of kin and creditors of B. Davis, deceased, late of said County, to appear at this term and show cause, if any they could, why Permanent Letters of Administration should not be granted to B. L. Davis, of said County; and they, the parties so cited, making no valid objections in the premises, it is ordered by the Court that Letters of Administration issue to B. L. Davis as Administrator of B. Davis upon his giving bond and securtiy in the sum of Six Thousand Dollars, and taking the usual oath of office. Recorded 16th day of March, 1921. Signed: Joe W. State of Georgia, Haralson County} By Joe W. Kelley and Ex-Officio Clerk of the Court thereof or said County, To B. L. Davis Greeting: Whereas, it has been represented to me that B. Davis late of said county, deceased, died intestate, and, whereas, it is futher represented to me, that said B. Davis at the time of his death was possessed of considerable property, and, whereas, it is further represented that there is great danger of waste of the said estate, for the want of due and legal administration being had on the same. Therefore, know all Men to whom these Presents shall be made known, That I, Joe W. Kelley Ordinary and ex-officio Clerk of the Ordinary of said County, have this day appointed you, the said B. L. Davis administrator of all and singular the goods and chattels, rights and credits of the said B. Davis deceased, temporarily, and until the next term of the Court of Ordinary of said County, to be held on the first Monday in March next, to collect, take care of, and to preserve from waste the real and personal estate of the said B. Davis in terms of the law, to the use, benefit and behoof of those who have a right thereunto. And you, the said B. L. Davis will take into your hands and psssession and keep safe from any waste, all the goods and chattels, rights and credits of him the said B. Davis deceased, until due and legal administration can be had thereon. And that you do make, or cause to be made, a true and perfect Inventory of all and singular the goods and chattels, rights and credits of the said B. Davis deceased; and the same so made, you return into my office on or before the first Monday in March next. And lastly, I do hereby constitute and appoint you, the said B. L. Davis a Temporary adminstrator for the time and purposes aforesaid. Given under my hand and seal of office, this the 31st day of January 1921. Signed: Joe W. Petition of Julia Ann Kirk Davis

No. 466, State of Georgia Haralson County. Petition for Year's Support, Appointment and Return of Appraisers. Estate of B. Davis Deceased. Mrs. Julia A. Davis Petitioner. Petition filed Feby 7th 1921. Recorded this 8 day of April 1921 Joe W. Kelley, Ordinary.

Georgia, Haralson County} To the Honorable Court of Ordinary of Said County: The petition of Mrs. Julia A. Davis respectfully showeth that B. Davis late of said County, departed this life on the 21st day of January 1921, leaving your petitioner, his widow, and 1 Dependant afflicted Daughter surviving him, and she prays your Honorable Court in conformity with the statute in such case made and provided, to appoint five discreet and proper persons to act as appraisers in setting apart to your petitioner and her Afflicted Daughter minor children as aforesaid, the sum necessary in their judgment for support and maintenance for the space of twelve months from the death of the said B. Davis of your petitioner and her children, either in money or such property as may be selected by your petitioner at a fair valuation to be made by said appraisers. And also to set apart a sufficient amount of household furniture for the use of your petitioner, and her children. And, further, to require said appraisers to return to you for record their proceedings. And you petitioner will ever pray, etc. Signed: Julia A. Davis (x- her mark) Petitioner. Witness: T. H. I, B. L. Davis Temporary Admr. of the estate of B. Davis deceased, do hereby acknowledge due and legal service of notice of the application of Julia Davis and her children for twelve months support. This 7th day of Feby 1921. Signed: B. L. Davis Haralson County Court of Ordinary at Chambers Feby 7th 1921. Upon the foregoing application of Julia A. Davis the widow of B. Davis deceased, for the appointment of appraisers to set apart to said widow and her Afflicted Daughter, a sum necessary for their support and maintenance for the space of twelve months, out of the estate of said B. Davis deceased, and, also, to set apart for the use of said widow and children, a sufficient amount of household furniture. It is orderd that C. A. Maner, Joe S. M. Biggers, O. F. Goldin, J. F. Garner, T. H. Hobbs be and are hereby appointed appraisers, and they, or a majority of them, are hereby empowered to set off and assign to the said Julia A. Davis widow of B. Davis deceased, late of said County and her support and maintenance of said widow and child for the space of twelve months; and, also, a sufficient amount of money or such property as the widow may select, at a fair valuation, to be made by said appraisers; and if, upon a just appraisement of the estate, the same does not exceed five hundred dollars, you set the whole apart. Further ordered, that said appraisers return to me for record all their proceedings in the premises. Given under my hand and official signature, this 7th day of Feby 1921. Signed: Joe W. Georgia, Haralson County} To the Honorable Court of Ordinary of Said County: We, the undersigned, appointed by the Honorable the Ordinary of said County of Haralson to assess and set apart a sum necessary for the support and maintenance of the widow and the afflicted Daughter of B. Davis deceased, for the space of twelve months, either in money or such property as the said widow may select, do report, that we have assessed and set apart as being necessary for the support and maintenance of said widow and said daughter the sum of One Thousand and Thrity five Dollars which the said widow has slected to take as follows: one Black horned milk cow and calf $15.00, Lots of land numbers 791 and 838 containing 40 acres each more or less and all of Lot No. 792 that lies in the East Side of Tallapoosa River being five acres more or less all being in the 20th dist and 3rd Sect. of Haralson County, Georgia at $1020.00. And we also set apart the following household furniture for the use of said widow and children: (Blank) In Witness Whereof, we have hereto set our hands and seals, this 9th day of Feby 1921. Haralson Court of Ordinary. At Chambers March 7th 1921. It appearing that the appraisers appointed to set apart a year's support for Julia A. Davis the widow and afflicted daughter of B. Haralson Court of Ordinary. April Term, 1921. The report of the appraisers appointed to set apart to the widow and afflicted child the provision allowed by law, being read, and the Court being satisfied that the same is in due form, and properly made, and citation having been issued and published, and no objection being filed, it is ordered that the same be admitted to record, and stand as the judgment of this Court. The State of Georgia, Haralson County} By the court of Ordinary of Said County. To C. A. Maner, Joe Biggers, O. F. Goldin, J. F. Garner, T. H. Hobbs. These are to authorize you, or any three of you whose names are here above written, to attend and appraise the goods and chattels, lands, tenements, rights, or credits of B. Davis, deceased, wheresoever any of the goods, chattels, lands, tenements, rights, or credits of said deceased are within the County of Haralson, and which shall be shown unto you by B. L. Davis, or come to your knowledge or sight, you having first taken an oath before some legally authorized person to make a true and perfect inventory thereof, and to cause the same to returned under your hands, or any three or more of you, to the said Court within two months from the date hereof. In testimony whereof I hereunto affix my hand and seal this 31st day of January, 1921. Signed: Joe W. Kelley, Ordinary.
