Land Deed between John W. Lee & R&C Railroad Co.

This was for a Right of Way. Recorded March 24, 1892, Filed Mch 24 at 9 A.M. 1892 J. S. M. Biggers, C.S.C.
State of Georgia County of Haralson: When as, The Rome and Carrollton Railroad Company, a corperation created by the law of the state of Georgia, is now about to construct a Railroad through the following land, VIZ: Lot No. 361 three Hundred & Sixty one in 1st Dist & 4th Sec of Haralson County Georgia, and in consideration of the building of said Railroad through said land, and for and in consideration of the sum of One Dollars paid, the receipt whereof is hereby acknowledged, J. W. Lee, of the county of Haralson, and State of Georgia do hereby give, grant, bargain, sell and convey unto the Rome and Carrollton Railroad Company, its sucessors, associates and assigns, forever in fee simple, a strip of land through the premises above described, along the line of said Railroad as now, or as it may hereafter be surveyed and located, one hundred feet wide, together with all the timber there and materials of every kind on said land situated, and with all the rights, members and apportion acres to said strip of land belonging as in any wise appertaining; and also give and grant to said Company and its assigns the privilege and right to cut down along the line of this said Railroad all trees which, by falling, might obstruct or encumber the track thenof. And J. W. Lee for myself, heirs, executors, administrators, sucessors and assigns, do hereby warrant, and will defend, the right and title to said strip of land unto the said Railroad Company, its sucessors and assigns, forever in fee simple, against the claims of all person whomsoever; and hereby release said Company from all claims for damages to the land and premises first herein described, by reason of the location, building, operating and maintaining this said Railroad through said lands. Probate: Georgia Haralson County In person appeared E. B. Barker, who being sworn says that he saw J. W. Lee sign seal and deliver the within deed for the purposes therein mentioned and that J.
