Petition of Nancy W. Lee on estate of John W. Lee, Sr

Filed Feb. 7, 1922. Recorded: March 29, 1922, Book 1, Page 94.
Georgia, Haralson County. To the Honorable Court of Ordinary of said County: The petition of Nancy W. Lee respectfully showeth that J. W. Lee , Sen. late of said County, departed this life on the 25th day of January 1922 leaving your petitioner, his widow surviving him, and she prays your Honorable Court in conformity with the statute in such case made and provided, to appoint five discreet and proper persons to act as appraisers in setting apart to your petitioner as aforesaid, the sum necessary in their judgment for support and maintenance for the space of twelve months from the death of the said J. W. Lee, Sen. of your petitioner either in money or such property as may be selected by your petitioner at a fair valuation to be made by said appraisers. And also to set apart a sufficient amount of household furniture for the use of your petitioner. And, further, to require said appraisers to return to you for record their proceedings. County Court of Ordinary. At Chambers Feby 4, 1922. Upon the foregoing application of Nancy W. Lee the widow of J. W. Lee, Sen. deceased, for the appointment of appraisers to set apart to said widow, a sum necessary for their support and maintenance for the space of twelve months, out of the estate of said J. W. Lee, Sen. deceased, and, also, to set apart for the use of said widow, a sufficient amount of household furniture. It is ordered that B. R. Ayers, W. P. Corban, C. S. McClarin, Elijah Kirk, G. W. Addison be and are hereby appointed appraisers, and they, or a majority of them, are hereby empowered to set off and assign to the said Nancy W. Lee widow of J. W. Lee, Sen. deceased, late of said County and her, out of the estate of the said deceased, a sum necessary for the support and maintenance of said widow for the space of twelve months; and, also, a sufficient amount of household furniture for the use of said widow. And the said sum so set apart as aforesaid to be either in money or such property as the widow may select, at a fair valuation, to be made by said appraisers; and if, upon a just appraisement of the estate, the same does not exceed five hundred dollars, you will set the whole apart. Further ordered, that said appraisers return to me for record all their proceedings in the premises. Given under my hand and official signature, this Feby 4th day of February 1922. Signed: Joe W. Inventory and appraisement of John W. Lee, Sr.

The State of Georgia, Haralson County By the court of Ordinary of Said County. To H. L. Brooks, H. T. Tuck, W. P. Corbin, C. A. Weaver and G. H. Wilson. These are to authorize you, or any three of you whose names are here above written, to attend and appraise the goods and chattels, lands, tenements, rights, or credits of J. W. Lee, deceased, wheresoever any of the goods, chattels, lands, tenements, rights, or credits of said deceased are within the County of Haralson, and which shall be shown unto you by G. T. Lee, or come to your knowledge or sight, you having first taken an oath before some legally authorized person to make a true and perfect inventory, thereof, and to cause the same to be returned under your hands, or any three or more of you, to the said Court within fifteen days from the date hereof. In testimony whereof I hereunto affix my hand and seal this 13th day of March 1922.

Oath of Appraisers.
You H. T. Tuck, W. P. Corbin, H. L. Brooks do swear that you will make a just and true appraisement and inventory of all and singular the goods, chattels, lands, tenements, rights and credits of J. W. Lee, deceased, as shall be produced to you by G. T. Lee the Administrator of the estate of said deceased, and will make a return thereof according to law. Sworn to and subscribed before me this 21 day of March 1922.

{From the foregoing appraisement is to be deducted the following which has been set apart to the widow of J. L. Lee: The sum of Twelve Hundred and seventy Seven dollars consisting of the equity of deceased in the following lands which is, with other lands of deceased, subject to a loan deed in favor of the Southern Mortgage Company. To-wit- (3) three acres of land in land lot No. 371 - 1st Dist & 3rd section of said county Commencing at the Northeast Corner of said lot, the line to run south along the original land line to a ditch, thence South westerly to the public road then North to the County line between Polk and Haralson counties, thence on the county line to the starting point: Also (15) fifteen acres in the Northwest Corner of said lot 371 with the above (3) three acres, the public road being between the two tracts. Said 15 acres is bounded on the east by the public road, on the North by the County line and west by lands of the A. B. Edwards estate and to run south far enough to include the 15 acres. And we also set apart to said widow 20 acres in land lot No. 370 said Dist and 3rd Sec. being the north half of said lot and not subject to any debt. - We value said land $1200. We also set apart to said widow 100 lbs. of meat valued at 150. 100 bushels of corn which we value at 50. We also set apart to said widow all the household said deceased owned at his death 12. (Total) $1277.}

We the undersigned appraisers, do certify that, having been first sworn by and before each other according to law, that the within and foregoing is a true inventory and appraisment of all the estate of J. W. Lee, deceased, so far as the same was produced before us by the G. T. Lee Administrator of said deceased, to the best of our judgment and understanding. Given under our hands and seals this 21 day of March 1922.

Personally came before me G. T. Lee Administrator of J. W. Lee, deceased, who, being duly sworn, deposeth and saith that the within and foregoing inventory is just, true and correct, and contains a true account of all the goods and chattels, rights and credits, and real estate of said deceased, that have come to his hands, possession, or knowledge. Sworn to and subscribed before me this 24th day of March 1922.
